BOOKING CONDITIONS

This is very important. Please read carefully.

iExpedition Pty Ltd (ABN 90 615 816 003) (iExpedition) has access to a number of Service Providers which enables the best possible deal to be obtained for you as the client. For this reason, expeditions advertised on our website are not conducted by us but by the relevant Service Provider offering the package best suitable to your requirements. Please refer to the terms and conditions of our engagement detailed below:

Booking Procedure

1.1 The booking between you and us comes into existence only after we have sent to you the quoted itinerary and invoice, and we acknowledge receipt of payment of the deposit.

1.2 If you make a booking on behalf of other people, you represent that you have the authority of each of the other people to enter into this contract and that you and they have agreed to be jointly and severally liable to us. In any event, you accept personal liability for the acceptance, and/or compliance, of each of those people with this contract.

Pricing

2.1 Expedition costs are based on the costs charged to us by our service providers at the time of publication. While we try our utmost not to increase the published prices, this is sometimes outside our control, so we reserve the right to amend our prices. Amendments should occur only in the event of marked fluctuations in the US dollar exchange rate or increases in the costs charged to us by service providers eg. fuel surcharges.

2.2 Once you have paid the tour price in full, iExpedition shall not increase the tour price save where such increases are imposed by government regulation or the costs charged to us by service providers. In those limited events, you will be required to pay the increased tour price.

2.3 The contract price is shown in the currency required by our service provider; it may not be the same as your country’s currency. Where the service provider’s currency is not Australian dollars, we may show the estimated Australian cost; however, the Australian dollar amount is an indicative only, and in the event of a dispute, the price on the day of final payment as shown in the currency of our service provider and determined by our consultants shall be the contract price, together with further payments, if any, required by these terms.

2.4 The estimate of the contract price as stated in your country’s currency may vary from time to time in line with movements in the value of the service provider’s currency against your country’s currency. Until final payment of the contract price is received by us, you assume the risk of all currency movements.

2.5 Dynamic Cabin Pricing;

Cabin prices on board a number of iExpedition's vessels are dynamic, that is the pricing structure is determined by the ship on the basis of fluctuations in inventory levels and exchange rates. Cabin prices on these vessels are not guaranteed and are subject to change and availability at the operator's discretion. Ships which feature dynamic pricing in the iExpedition product range include, but are not limited to the Fram, Roald Amundsen, Fridtjof Nansen, La Boreal, Le Lyrial, Le Soleal, Le Laperouse, Le Champlain, Endeavor, Silver Cloud, and Silver Explorer. Please contact iExpedition for confirmation of cabin pricing, and any queries you may have.

 

Deposit

3.1 At the time of booking you must pay a non-refundable deposit of 25% of the price for the tour. A booking will not be confirmed until iExpedition has confirmed the acceptance of the booking and receipt of the deposit.

3.2 Should your booking be made less than 125 days before the departure date the entire contract price must be paid at the time of booking.

3.3 Some of iExpedition's cruise partners may have varying deposit and payment terms, this is particularly true of smaller operators. iExpedition reserves the right to deviate our standard terms to be in-line with partners terms where the above terms are not suitable. 

 

Payments

4.1.1 You must pay the balance of the price of the tour not less than 125 days before the departure date of your cruise, as stated on your invoice

4.1.2 Should the balance of the tour price not be paid in accordance with the above requirement, then iExpedition may cancel your booking with no refund due.

4.1.3 Some of iExpedition's cruise partners may have varying deposit and payment terms, this is particularly true of smaller operators. iExpedition reserves the right to deviate our standard terms to be in-line with partners terms where the above terms are not suitable. 

Payment methods

4.2.0 All prices are based on payment by cash, EFTPOS or direct deposit. Cheques are not accepted.     

4.2.1 You may pay the contract price by direct deposit to our clients’ account, or by a third-party payment system. Without prejudice to any other right that you may have, should you make a payment through a third party, such as a credit card provider, you agree that you will not subsequently dispute the payment, or payments, and you waive all rights to do so with your third party credit provider.

4.2.2 Visa or Mastercard

Payment of the deposit up to 25% of the contract price by Visa or Mastercard does not incur any credit card processing fees. All other payments by you by Visa or Mastercard will, in addition to the contract price, incur a transaction fee of 1.55% of the amount debited to your credit card, which you agree to pay.

4.2.3 American Express

Where you make a payment by International card (non-Australia) or American Express credit card you agree to pay a transaction fee of 3of the amount debited to your credit card, in addition to the contract price.

4.2.4 Bank Transfer

Bank fees incurred by us when you transfer funds to foreign currency denominated accounts are payable by you, and the amount of those fees must be added to the contract price quoted by ourselves.

The Payment Processing Fee (credit card fee) charged directly by TravelPay is not refundable under any circumstances, including on refunds.

Direct Deposit: Payments made via direct deposit take up to 3 business days to process. Please notify your consultant of your payment once it has been processed. Payment can be made by direct deposit as follows:

4.2.7 Fraudulent Bank Accounts

iExpedition is not responsible for any payment sent to a fraudulent bank account. 

iExpedition recommends phoning the business to confirm account details over the phone or via SMS. 

Availability, Reservation & Booking Policy

5.1 You may reserve cabins for up to a 72-hour period without charge. Bookings held under reservation are not confirmed nor guaranteed.

5.2 The availability of cabins shown on our website is indicative only and subject to confirmation from our service provider. Upon receipt of a booking request and the required amount of the deposit we confirm the request with our service provider; and only when we receive confirmation from the service provider of the availability of a cabin, do we process credit card payments.

 

Delay or Change of Itinerary

6.1 Our service providers may, for a variety of reasons, change the date of departure or conclusion of the tour, the scheduled point of departure or return, or omit or change any stop whether before or after the tour has departed. You will have no right to any refund and iExpedition will have no obligation to you or be liable for any loss, consequential damages, expenses, loss of time or enjoyment or inconvenience in respect of such changes.

 

Cancellations

Cancellation by you

7.1 If it becomes necessary for you to cancel your adventure, please notify your Travel agent or our sales consultant immediately in writing. Cancellation will take effect on receipt of your written notice by iExpedition.

7.1.1 Where the cancellation notice is received by us more than 125 days before scheduled departure date, the company shall refund to you all monies paid less the 25% deposit paid; which the company shall be entitled to retain.

7.1.2 In such event, your deposit, at your request, may be transferred to another expedition with the same service provider (at the provider's discretion) departing within 12 months of your original departure date for a fee of $500pp. Funds will not be held in suspense, and a new booking must be advised at the time of cancellation of the original booking. You must pay the difference between the original booked price and the price of any transferred booking, if any, including the new deposit amount.

7.1.3 We pay the service provider for the cruise 125 days before the departure of the ship. Where Cancellation Notice is received by us less than 125 days before the departure date, then all payments made shall be forfeited in full, and you will not be entitled to any refund. At your request, we will seek a gratuitous refund from the service provider, however, the decision to make any refund is solely in the absolute discretion of the service provider.

Cancellation by us

7.2.1 We will use our best endeavours to provide you with the adventure as advertised. However, due to reasons beyond our control, our service providers may decide to cancel or vary a tour, be it for technical, mechanical, natural disasters, safety issues, terrorism, industrial action, political instability, weather conditions, force majeure or any other event whatsoever. You will have no right to any refund and iExpedition Pty Ltd will have no obligation to you or be liable for any compensation or damages, for any loss, consequential or indirect damages, expenses, loss of time or inconvenience, loss of opportunity or loss of enjoyment in respect of such changes. Such changes may not be used by you as a reason for cancelling the trip or to put forward a claim of any kind to iExpedition Pty Ltd.

7.2.1.1 iExpedition Pty Ltd will not be responsible for the performance of the contract if prevented or delayed by acts considered force majeure or acts of God, strikes, or other industrial relations matters, technical or mechanical issues, accidents, weather, traffic, airport conditions, endemic/pandemic, lack of performance by third party suppliers, or other causes beyond their control.

7.2.2 Should, for reason of a medical condition, the service provider reserves the right to decline to accept your booking/boarding, without refund or resulting expenses to any passenger for any reason at the service providers discretion.

7.2.3 Where it is necessary for the service provider to substantially vary, or cancel the tour, you may request:

A refund of so much of the price that has been paid, and iExpedition: (i) will refund the price to the extent that it can be recovered from our service providers without resorting to legal proceedings; or (ii) to credit so much of the tour price paid by you as we can reasonably and properly credit, allowing for a credit note to be received from your service provier and all the circumstances, to another tour offered by the same service provider.

7.2.4 Our service operators have various requirements that you must comply with including completing a questionnaire to assist with the running of the adventure concerning issues such as clothing size, medical conditions, and other matters. They will also require your agreement to their Conditions of Carriage. It is essential that the Conditions of Carriage and ancillary documents are returned to us completed and signed by yourself within 14 days of your booking confirmation, or 125 days before the schedule departure date, whichever is the earlier date. If there is less than 125 days between your booking and the scheduled departure date, the documentation must be completed, signed, and received by us within 7 days of the date of your booking confirmation. Should you not provide these documents within the time frame mentioned, our service providers will not allow you to board the ship, and we reserve the right to cancel your booking.

7.3 The conditions of carriage and ancillary documents of the relevant service providers are deemed to form part of this agreement with any necessarily and appropriate changes.

7.4 In relation to voyages which include a charter flight to begin the voyage, no refund will be provided to you for the voyage if the flight is successfully completed regardless of which day it was executed up to 72 hours after the originally scheduled flight time, or if the voyage is fully cancelled after unsuccessfully attempting to depart for up to 72 hours after the originally scheduled flight time. iExpedition will not be liable for and does not accept any claims for any costs made by you including but not limited to international airfares, domestic airfares, accommodation, any additional services purchased, or change fees impacted by or as a result of the delay or cancellation of a voyage with charter flights. iExpedition will provide a trip interruption letter to be submitted by you to your insurance company for the airfare, change fees, re-booking fees, and other expenses incurred due to the trip interruption or cancellation.

 

Exclusions

8.1 The tour covers the period from embarkation to debarkation. It is your responsibility to be at the point of departure at the scheduled time and date, and that means that you must make your own arrangements and cover your own expenses up to embarkation.

8.2 The tour ends when you disembark from the tour vessel, and your travel arrangements and expenses from the point of debarkation are your responsibility.

Age & health requirements

9.1 Your safety is of paramount importance to us and therefore it is imperative that you advise us at the time of your booking, of any conditions medical or otherwise, and/or disability that might affect your or other people’s enjoyment of, or the normal conduct of the tour.

9.2 If required by us you must provide an assessment of your medical condition from a registered medical practitioner.

9.3 We reserve the right, at our discretion to cancel your booking and refund the moneys paid by you, less any unrecoverable costs, should we be of the view that your medical condition might adversely affect your participation in the adventure, or the conduct of the expedition.

9.4 Due to the adventurous nature of our tours all participants who are under the age of 18 years, must be accompanied by their legal guardian, or an escort over the age of 18 years appointed by their legal guardian. The legal guardian, or escort, will be solely responsible for the day to day care of the traveler under the age of 18 years. While there is no upper age limit on our tours the trips can be physically demanding and you confirm that you, and any minor traveling with you, are suitably fit to allow full participation.

9.5 All iExpedition service providers have different policies for children, which include varying age restrictions. Children under the age of 16 years at the time of travel, are unable to be confirmed online, without prior consent from iExpedition.

 

Passports, Visas & Travel Documents

10.1 You must carry a passport with validity for the minimum duration required based on the countries you are visiting.

10.2 When booking a cruise visiting an international port, you are responsible to ensure you have all necessary visas, permits, certificates, vaccinations and travel documents to safely enter the countries you intend to visit.
 

Mandatory Travel insurance

11.1 Travel insurance is compulsory for all our travellers. You are required to be covered by a comprehensive travel insurance policy that includes emergency evacuation, medical repatriation and medical expenses. We travel to remote regions, so we recommend that the policy’s emergency evacuation benefit be higher than the minimum and cover you for remote evacuation should be it be required. Please ask your iExpedition consultant or travel agent about travel insurance and insurance against the Service Provider’s insolvency.

iExpedition only provides advice on Sure Save travel insurance policies and recommends the Sure Save policy because of their repatriation coverage and insolvency coverage.

You will not be issued with your final cruise documentation and will not be able to join the cruise without providing a copy of your travel insurance policy. 

11.2 We recommend that you take out your travel insurance policy when you book your adventure. You may also wish to consider deposit or cancellation insurance where there is an extended period between booking and your scheduled departure date.

11.3 Our consultants are happy to discuss these issues with you.

 

Acceptance of risk

12.1 The tours offered by the company are of an adventurous nature, and you acknowledge that, in addition to the usual risks inherent in travel, the trip has additional risks, such as weather extremes, remoteness from medical services, evacuation difficulties if you are disabled, or physical exertion for which you may not be prepared, and others. You also agree that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and that these inherent risks contribute to such enjoyment and excitement, being the reason for your participation. In making the booking, you accept all risks and agree that it is a condition of the booking that you travel at your own risk.

12.2 Except to the extent that this clause may be prohibited or restricted by the Trade Practices Act 1974 or other legislation you release and indemnify iExpedition, its employees and agents from all claims and actions that you, or a party claiming through you, may have or may have at any time in the future against them, howsoever arising, for personal injury, death, property damage, economic loss, or any other loss, or expense whatsoever that you may suffer as a result of your participation in any trip organised with or in conjunction with iExpedition.

12.3 In the event that you suffer injury or illness you agree that iExpedition or its service providers or agents, can, at your cost, arrange medical treatment and emergency evacuation service, as iExpedition, its service providers, or its agents deems essential for your safety.

 

Third Parties

13.1 We contract with a network of Service Providers to operate the tours. Without prejudice to any claim you may have against the Service Provider, you agree not to claim against iExpedition or its employees for any act or omission on the part of the Service Provider and you release and indemnify us from all losses, whatsoever, howsoever arising from all acts and omissions of the Service Provider.

13.2 At all times, the decision of the expedition leader and/or representative will be final on all matters likely to affect the safety and well-being of expedition members and the trip. This includes any decision that the expedition leader makes about the client’s ongoing participation in the trip or certain activities that comprise part of the trip. If the client fails to comply with a decision made by the expedition leader, or interfere with the well-being of the group, the expedition leader reserves the right to terminate this Agreement and order the client to leave the expedition immediately, with no right of refund from the operator or iExpedition will not be liable for any compensation, costs, damages or losses arising from such termination.

13.2.1 The decision of our service provider’s leader or representative will be final on all matters likely to affect the safety and well-being or mobility of the participants of the expedition. This includes any decision that iExpedition or its service providers, make about your ongoing participation in the tour or any activities that form part of the tour, with no right of refund.

13.2.2 If you fail to comply with a decision of the expedition leader, or interfere with the well- being of the group, the expedition leader may terminate this contract and order you to leave the tour immediately

13.2.3 You agree that at all times you will comply with the laws, customs, foreign exchange and drug regulations of all countries and territories visited.

 

Severability

14.1 In the event that any term of the contract is unenforceable or void by operation of law or for any other reason, then the remaining provisions will not be affected and this contract will be construed so as to most nearly give effect to the intentions of the parties at the time it was entered into.

 

Assignment

15.1 This contract confers rights only upon a person expressed to be a party; you must not assign or transfer any right or liability under this contract without the prior written consent of iExpedition.

 

Feedback

16.1 We try our utmost to provide you with a happy and fulfilling tour, but if we fail in any way, please make it known to your iExpedition consultant, who will be able to take the appropriate action. If your complaint is not dealt with to your satisfaction, then you should give us full details in writing, immediately on your return. We cannot respond to verbal complaints.

 

Photos & marketing

17.1 You consent to us using images of you taken during the expedition for advertising and promotional purposes in any medium we choose; and release all rights over those images. Anyone who does not wish to be photographed must advise us in writing prior to the commencement of the adventure.

 

Superseding Representations

18.1 The terms set out in this document supercede any previous representations, understandings, arrangements or terms between the parties.

 

Privacy policy

20.1 You acknowledge that you have read and agree to the terms of our privacy policy.

 

Applicable law / Service of Suit

21.1 The contract between yourself and iExpedition is to be construed in accordance with the laws governed by the State of Queensland, and, as appropriate, the Commonwealth of Australia.

22.2 If a dispute arises in relation to our products and/or services, this dispute will be subject to Australian law and practice and the complainant will submit to the jurisdiction of any competent Court in the State of Queensland within the Commonwealth of Australia;

22.3 Any summons notice or process is to be served upon Robert Harris Rivett Lawyers as follows:

Who has the authority to accept service on iExpedition Pty Ltd’s behalf; 

22.4. If a suit is instituted against iExpedition Pty Ltd, the complainant will abide by the final decision of such Court or any competent Appellate Court in the jurisdiction of the Commonwealth of Australia
